Terms of Use

Last updated: October 18, 2026

These terms apply to the apps published by Benbow Labs, a division of Mapleworx Services Inc., a Canadian federal corporation located in Ontario, Canada ("Benbow Labs", "we", "us"). They apply whatever device you use and wherever you got the app. Section 1 explains which copies of our apps are official, and what that means if yours isn't. "The store" means the app store you got an official copy from, if you got it from one. These terms are between you and us.

An app's page may set additional terms that apply only to that app. If it does, they are in a clearly headed section of that app's page, listed in our Privacy Policy. Where they describe that app differently from, or more specifically than, these terms (for example, how it is sold or what an account includes), they apply for that app. They can add protections, but they cannot reduce any protection you have under these terms. If the two ever conflict about a protection, whichever protects you more applies.

The store's own terms also apply between you and the store, for example to your store account and to how you pay. These terms don't cover our websites, which have their own Website Terms, except for any app or purchase offered on one of them, which these terms cover.

Accepting these terms. Each app links to these terms, and we show you a link to them before you buy anything in it. By buying an app or a purchase in one, or by using an app after we have shown you these terms, you accept them. If you don't accept them, please don't use the app. If you bought an app or a purchase in one and you don't accept these terms, write to us within 30 days of buying and we will refund you.

1. Your licence

We give you a personal, non-exclusive, non-transferable licence to install and use our apps on devices you own or control, as the store's rules or the app's page allow, including through any family-sharing feature the store offers for that app.

Some of our apps are free. Some cost money, or offer in-app purchases or subscriptions. What a purchase unlocks, and for how long, is shown before you buy it. A one-time purchase does not expire. A subscription unlocks what it says while the subscription is active.

Your licence does not expire. It doesn't promise future updates, fixes or new features; section 5 says what we do and don't promise about those. We may offer paid upgrades in future, such as a new major version of an app or an upgrade purchase, sold separately. Your purchase covers what it unlocked when you bought it, and an upgrade never takes that away (section 5).

Official copies. An official copy of one of our apps comes only from an app store we publish that app on, or directly from us, at benbowlabs.com or the app's own website. A copy from anywhere else isn't supported. That includes a copy from a file-sharing site or an unofficial app store, and a modified or "cracked" copy. We can't vouch for such a copy: it may have been altered, and it may not be safe to use. Your licence, and anything you buy, applies only to official copies. Using it with any other copy is at your own risk: our support doesn't cover that copy, and we don't refund on the grounds that it didn't do what we say our app does. If a copy gets around a purchase or a licence check, there is no licence to what wasn't paid for.

This is a licence, not a sale of the software itself. We and our licensors keep all intellectual property rights in the apps, including their code, design, names, logos and content.

2. What you may not do

You may not:

  • copy, redistribute, sell, rent, lease or sublicense an app;
  • reverse engineer, decompile or disassemble it, except for good-faith security research of the kind our Support page describes, and to the extent that applicable law gives you that right despite this clause — including for interoperability or the exercise of a right that cannot be contracted away;
  • remove or alter any copyright, trade-mark or other proprietary notice;
  • use an app to break the law, or to infringe anyone else's rights;
  • circumvent a purchase, licence check or usage limit.

Nothing here restricts what you may do with your own data in one of our apps. It is yours, you can export it where the app offers an export, and you can do whatever you like with it.

3. Your content and your data

You keep all rights in the content you create or open with our apps. We claim no ownership of it.

Where an app keeps your data only on your device, we have no copy of it, so if you lose, reset or wipe your device, we cannot recover it for you. We recommend you keep your own backups. Each app's page says where its data is kept, what your device's backup includes, and whether the app offers an export.

If an app ever stores or shares your content off your device, its page will say so, and any permission it needs from you to do that will be limited to what it needs to provide, secure and support that feature, as its page describes. See the Privacy Policy for how we handle information about you.

4. Purchases, refunds and who the seller is

We are the seller of our apps, everywhere. If you buy through an app store, the store takes your payment and handles it under its own terms. On Google Play, in some countries, mostly in the European Union, the European Economic Area and the United Kingdom, Google acts as our agent and is the "merchant of record" for tax and payment purposes. Everywhere else, including Canada and the United States, we are the merchant of record, and a Google payments company collects the payment for us. Another store may arrange this differently; if so, the app's page says how. Either way, we are responsible to you for the app under consumer law.

When you buy through an app store:

  • The store takes your payment. We never receive your full card number or security code.
  • The price is the one the store shows you before you confirm the purchase.
  • What you are buying is described in the store listing and on the app's page: what the purchase unlocks, and for how long.
  • Purchases unlock features for the store account that made them, and for anyone the store's family-sharing features allow, or, for an app with accounts, as its page says.
  • If you subscribe, you can cancel at any time in the store. After you cancel, no further payments are taken. You keep access until the end of the period you've already paid for, and then it stops. Deleting the app does not cancel a subscription. Your legal rights to cancel, below, still apply.

If an app is sold another way, its additional terms cover payment, price, refunds and cancellation.

If you are under the age of majority where you live, you need a parent's or guardian's permission to buy anything from us.

Refunds and cancellation

Our refund promise. If a paid app or purchase doesn't do what its page or store listing says, on a device it supports, we will refund it if you ask within 30 days of buying it. We also refund you if you don't accept these terms and write to us within 30 days of buying (see the start of these terms). These time limits apply only to our own promises; your legal rights in section 7 still apply, whenever you ask.

What the promise doesn't cover. Our promise doesn't cover problems caused by things outside our control, such as a change to your device's operating system, to your device, or to the store. It also doesn't cover a copy of an app that isn't official (section 1). This is a limit on our promise only. It doesn't limit your legal rights in section 7, and the law may still give you a remedy.

If we remove a feature you paid for. Section 5 explains when we can, and when we refund.

How to ask. Email [email protected] with the app, the order number and what went wrong. We will reply within 10 business days with our decision and the reason for it. If we say no, we will tell you how you can take it further. Our Support page explains the steps.

How refunds are paid. We make refunds through the store you bought from, where the store lets us issue them. We never refund by cheque or bank transfer. Where the store doesn't let us refund (Apple's App Store, for example), we will help you ask the store for it. You can also ask the store directly, under its own refund policy.

Your legal rights to cancel. Nothing in these terms limits a right you have under law to cancel a purchase or get a refund. For example, consumers in the European Union and the United Kingdom have a 14-day right of withdrawal in some cases, and in Quebec and Ontario the law lets you cancel a purchase made online or at a distance if we didn't give you the information the law requires before you bought. If anything here appears to conflict with those rights, those rights win.

5. Updates, and if we stop developing an app

We may update our apps, but we don't promise to (section 1). An update may change or add features. A new feature, or a new major version, may be offered as a paid upgrade, sold separately; it never takes away what you already paid for. Your device may install updates automatically, depending on your settings.

We only remove or materially reduce a feature you paid for if a law, a store rule or a change to your device's operating system requires it. If we have to, we will tell you in the app at least 30 days beforehand where we can. If the feature was something you paid for on its own, such as a separate in-app purchase, and we remove it within 12 months of your purchase, we will refund what you paid for it. We don't refund a feature removed after those 12 months. If the feature came as part of a larger purchase, such as an app or an unlock that covers the whole app, this promise doesn't include a partial refund. These limits apply only to our own promise; your legal rights in section 7 still apply, whenever the feature is removed.

We may stop updating, supporting or distributing any app. If we stop developing an app, we will say so on its page, and in its store listing while it is still listed. Each app's page says whether it depends on a server of ours and what to expect if we stop. We don't promise support, updates or fixes for any particular length of time, except where the law or the store's terms require them (see section 7). We don't give refunds because we stop developing or distributing an app; that too is a limit on our own promise only, and section 7 still applies.

6. What we promise, and what we don't

If you live in Quebec, the next paragraph does not apply to you.

Apart from section 7, we make no promises about an app beyond what we say in its store listing and on its page.

Where an app gives you a record or a reminder that matters to you, or anything you pass on to someone else, check it. An app is a tool to help you; it is not accounting, tax, legal, medical, navigational or safety advice.

Don't rely on any of our apps where a failure or a mistake could cause injury, death or serious loss. They are not designed, tested or certified for that.

7. Your consumer rights come first

Nothing in these terms takes away a right you have under consumer protection law that cannot be waived. Sections 6 and 8 apply only to the extent the law allows; where the law does not allow them, they do not apply to you. This section governs everything else in these terms.

You can stop using an app at any time. That is always open to you, but it isn't your only option. If an app doesn't do what it should, the law where you live may give you other remedies. In plain words:

  • Ontario: what you get must match its description, be of merchantable and reasonably acceptable quality, and be fit for any purpose you made known to us. We do not exclude or vary any condition or warranty the law implies, and we do not limit the amount you may claim if one is broken.
  • Quebec: what you get must be fit for the purposes it is ordinarily used for, last a reasonable time in normal use, and be free of hidden defects. If you bought online or at a distance, the law may let you cancel the purchase. You may claim damages, including punitive damages. We cannot exclude or limit our liability for our own acts, and section 8 does not apply to you.
  • The European Union and the United Kingdom: an app must match its description and be fit for purpose and of satisfactory quality. If it isn't, you can ask us to fix it, and if that isn't possible or doesn't happen within a reasonable time, you may be entitled to a price reduction or a refund. In the UK, if an app damages your device or other digital content because we didn't take reasonable care, you may be entitled to a repair or compensation, even if the app was free.
  • New Jersey: the limits in sections 6 and 8 do not apply to a claim under the New Jersey Consumer Fraud Act, and nothing in these terms limits your rights under that Act or under the Truth-in-Consumer Contract, Warranty and Notice Act.
  • Everywhere else: you have whatever rights your local consumer law gives you.

These are summaries, not the full rules. If anything in these terms conflicts with your rights under the law, the law wins.

8. Limitation of liability

If you live in Quebec, this section does not apply to you.

Subject entirely to section 7:

  • We are not liable for loss or damage that was not a reasonably foreseeable result of our breaking these terms or failing to take reasonable care, or for lost profits, lost business or lost opportunity.
  • We are not liable for lost data, except where it was caused by our failure to take reasonable care.
  • We are not liable for a failure caused by your device, its operating system, or a third-party service outside our control.
  • Our total liability to you for all claims relating to an app is limited to the greater of the total price you paid for that app and its in-app purchases, including subscriptions, in the 12 months before the claim and CAD $100. This is a ceiling on what we could be responsible for, not an amount we owe you, and it is not a refund: refunds work as set out in section 4.

Nothing in this section limits our liability for death or personal injury caused by our negligence; for fraud; for gross negligence or wilful misconduct; for breaking a warranty, guarantee or conformity requirement the law gives you; for damage to your device or to other digital content caused by our failure to take reasonable care; or for breaking privacy law.

9. No arbitration, and no waiver of class proceedings

We do not require you to arbitrate, and we do not ask you to give up your right to bring or join a class proceeding. You keep every avenue the courts give you.

10. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there.

If you are a consumer, this does not deprive you of the protection of the mandatory laws of the country, province or state where you live, and it does not stop you bringing a claim in your local courts. If you are not a consumer, the courts of Ontario have jurisdiction.

11. Changes to these terms

Why we might change them. We may change these terms only to reflect a change in the law or in a store's rules; a change in how our apps work or are distributed; a new app or feature; a change in our cost of providing an online service or a subscription; or to make them clearer or correct a mistake.

What we can change. Sections 2, 3, 4, 5, 6, 8, 12 and 13, and the additional terms on an app's page. We will not change sections 1, 7, 9, 10 or this section 11 in a way that reduces your rights. We will never change the essential parts of something you have already bought, such as the price you paid or what a one-time purchase unlocks.

How we give notice. At least 30 days before a change takes effect, we publish a notice on this page, and show it in each app the change affects, where the app can show it. The notice shows the wording that changes, the new wording, the date the change takes effect, and your right to refuse it. For each app, a change doesn't apply to you until that app has shown you the notice. If an app can't show it, for example because we have stopped updating it, the change never applies to you for that app, and the terms you had keep applying to it.

Your right to refuse. You can refuse a change by telling us, at any time up to 30 days after it starts to apply to you. If you do, the terms you had continue to apply to the apps you already have. You can also end your agreement with us, and cancel any subscription, at no cost and with no penalty. If you don't refuse a change, it applies to you from the date it takes effect, or from when an app showed you the notice, if that is later.

What counts as a change. Changing the additional terms of an app you already have is a change, and follows this section. Additional terms for a new app, or for a feature you choose to start using, are not a change to the terms you already have. Updating our name or contact details after we transfer these terms under section 12 is not a change either, and doesn't alter any of your rights.

The "last updated" date always reflects the current version. If you'd like a previous version, email us and we'll send it.

12. Odds and ends

  • Severability. If a court finds a provision unenforceable, that provision does not apply to the extent it is unenforceable, and the rest stays in force.
  • No waiver. If we don't enforce something immediately, we haven't given up the right to.
  • Transfer. You may not transfer these terms to someone else. We may transfer them to an affiliate or to a successor of our business, and not in a way that reduces your rights. If we do, we publish a notice on this page, and show it in our apps where they can show it.
  • How we contact you. We contact you directly only if we have a way to: for example, an email address you gave us. Otherwise, where these terms or our Privacy Policy say we give notice, we do it by publishing it on our website and, where an app can show it, in the app.
  • Our whole agreement. These terms and any additional terms on the app's page are our agreement about the apps. They do not override what we told you about an app in its store listing or on its page; that binds us too. Our Privacy Policy is a notice to you, not part of this contract. The store's own terms apply between you and the store.
  • Language. These terms are available in English and French. If you live in Quebec, we give you the French version first, and you are bound by the English version only if you have expressly chosen it. Wherever you live, both versions are equally valid, and if they ever differ, the reading more favourable to you applies.
